Terms of Service
Last updated:
1. Agreement to Terms
By accessing or using the 3D Build Designer website, hosted designer, contractor tools or related services, you agree to these Terms of Service. If you do not agree to these Terms, do not use the service.
2. What 3D Build Designer Is
3D Build Designer is a lightweight visualization, sales and lead-generation platform for pole-building and post-frame companies.
It is not:
- Engineering software.
- Structural design software.
- Estimating software.
- A material takeoff system.
- Construction-document software.
- A substitute for professional engineering, architectural, permitting or construction advice.
Designs are conceptual, not construction approvals. Building dimensions, visualizations, colors, layouts, framing representations and configurations are informational and conceptual unless a contractor separately verifies them. Using the service does not establish that a design is structurally engineered or code compliant.
3. Accounts and Authorized Use
Contractor accounts are for authorized users. Users are responsible for protecting their login credentials and for activity performed through their accounts.
Accounts may not be shared in a way that bypasses purchased access or compromises security.
4. Customer Design Submissions
Customers may use the designer to configure a building and submit project information to the subscribing contractor associated with the designer.
Submitting a design does not create:
- A construction contract.
- A guaranteed price.
- An engineering approval.
- A permit.
- A warranty that the design can be built exactly as shown.
The subscribing contractor is responsible for reviewing the project, communicating with the customer and determining feasibility, pricing, engineering and construction requirements.
5. Contractor Relationship
3D Build Designer provides software to independent pole-building and post-frame companies. Unless expressly stated otherwise, 3D Build Designer is not the contractor, builder, engineer, architect or seller of the building ultimately purchased by an end customer.
6. Guided Trial
Qualified companies may be offered a guided 7-day trial. No credit card is required for the current guided trial. Trial eligibility, configuration and available functionality may be determined by 3D Build Designer.
A trial does not automatically convert into a paid subscription. No customer should be charged merely because a no-credit-card trial expires. Paid service begins only after the customer affirmatively agrees to paid service.
7. Pricing and Setup
Founding Builder Launch Pricing is limited to the first 4 paying contractors:
- $99 per month.
- $149 one-time setup.
Contractors using a free trial may qualify upon affirmative subscription. A trial alone is not a paid conversion, and complimentary pilot participation does not count toward these paid founding positions. Subscription and setup charges begin only after affirmative acceptance of the paid service terms.
The $99 monthly founding rate remains locked while the customer's subscription remains continuously active and in good standing.
After the program is filled, the standard setup fee returns to $999 and future subscription pricing may differ. A future standard monthly price has not yet been published.
Setup may include company configuration, branding, building options, palette configuration, hosted domain or subdomain configuration, lead-delivery setup and launch assistance.
Non-standard integrations or customization may be separately scoped and priced.
8. Billing, Renewal and Cancellation
Unless another written agreement or order form says otherwise, recurring subscriptions are billed monthly in advance and continue until canceled.
Customers may cancel future renewal by contacting 3D Build Designer at sales@3dbuilddesigner.com before the next billing date.
Cancellation ends future renewal but does not retroactively refund a subscription period already purchased, except where required by law or agreed in writing.
The setup fee covers configuration and onboarding work. Once configuration work has begun, the setup fee is generally non-refundable except where required by law or otherwise agreed in writing.
Billing, invoices and recurring subscription collection are handled through an external billing system, separately from the 3D Build Designer application. Applicable invoice or order terms will be provided to the customer.
9. Acceptable Use
Users must not:
- Use the service for unlawful purposes.
- Attempt unauthorized access.
- Interfere with platform operation or security.
- Introduce malicious software.
- Scrape, copy or systematically extract protected platform data without authorization.
- Reverse engineer or attempt to obtain non-public source code except where applicable law expressly permits it.
- Impersonate another person or company.
- Submit information the user has no right to provide.
- Use the service to infringe intellectual property or privacy rights.
- Abuse trial access or attempt to circumvent account, tenant or subscription restrictions.
10. Intellectual Property
The 3D Build Designer software, visual design, interface, branding and platform technology remain the property of their respective owner or licensor.
Customers retain ownership of business logos, brand materials and other content they supply. Users grant only the limited rights necessary for 3D Build Designer to host, process and display supplied content as needed to provide the service.
11. Availability and Changes
Features may be improved, modified or discontinued. We make reasonable efforts to keep the service available, but uninterrupted operation cannot be guaranteed.
12. Third-Party Services
Portions of the service may depend on third-party infrastructure, email, authentication, hosting, payment or related services. Those systems may have their own terms governing their use.
13. Disclaimer of Warranties
To the extent permitted by law, the service is provided on an “as available” basis without warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.
3D Build Designer does not guarantee construction feasibility, structural suitability, building-code compliance, permit approval, pricing accuracy, material quantities, contractor performance or project outcome. Any rights or warranties that cannot lawfully be excluded remain in effect.
14. Limitation of Liability
To the maximum extent permitted by law, 3D Build Designer will not be liable for indirect, incidental, special, consequential or lost-profit damages arising from use of the service. This limitation does not exclude liability that cannot be excluded under applicable law.
15. Suspension and Termination
Access may be suspended or terminated for nonpayment, material violation of these Terms, security threats, misuse or unlawful activity.
Customers may stop using the service and may cancel recurring service as described in the Billing, Renewal and Cancellation section above.
16. Changes to Terms
We may update these Terms as the product and commercial model evolve. Material changes will be reflected through an updated date.
